HOA (Homeowners Association) Law

The past few decades have seen an explosion of homeowners associations (HOAs) and other types of community associations in the United States, and it's no wonder that many people find themselves with some sort of HOA-related issue. It's estimated that more than 50 million Americans now live in homes that are part of an HOA, and that four out of every five new housing starts will be part of an HOA. Whatever their pros and cons, HOAs appear to be here to stay.

All HOA Issues Accepted

Stephen Varga has the knowledge and skills to help resolve HOA matters, whether they concern a homeowner with a dispute against an HOA or a board of directors of an HOA that needs help. He's familiar with the problems that can arise when you're a member of an HOA, including issues regarding:

A Variety of Services

Mr. Varga provides legal services such as drafting bylaws and amendments; negotiating with HOA members, vendors, and contractors; interpreting, updating, and helping enforce the HOA governing documents; assisting in the collection of unpaid assessments; and dealing with litigation arising from construction defects.

HOA Amenities

Whether your homeowner's association or community association (CA) is as small as a multi-unit condominium building or as large as a planned community with thousands of homeowners, the principles of home ownership in an HOA are the same. The purpose of the HOA or CA is to protect, maintain, and enhance the common interests and common areas of the association. The HOA makes amenities available to its members that the individual homeowner members may not be able to afford on their own, such as a pool, tennis courts, landscaping, and a clubhouse, among other things.

Each of the homeowner members pays an assessment to help cover the cost of maintaining these amenities. Sometimes disputes arise concerning increases in the assessment, or the inability or refusal of individuals to pay the assessment.

HOA Restrictions

Other common HOA issues are due to the restrictions placed on the homeowners. The number of possible restrictions is extensive and may include:

  • Colors accepted for home exteriors
  • Landscaping on private residences
  • Parking of multiple vehicles, RVs, and boats
  • Satellite dish placement
  • Signs on private property
  • The length of time that visitors may stay at a home
  • Number and type of pets
  • Vegetable gardens
  • Treehouses
  • Solar collectors

Unfortunately, many people who purchase a home that is part of an HOA or CA are not fully informed about the restrictions that they are agreeing to when they buy the home, and this often leads to disputes between homeowners and the HOA board of directors.
