Assault charges could range from misdemeanor level to life in prison. They can be combined with gang enhancements and gun enhancements or both, and result in very long prison terms.
Assault on a police officer is in a different category altogether. Just as in cases of resisting arrest, a case of assault on a police officer must be explored for the possible use of excessive force by the police. In the last case Mr. Varga handled involving resisting arrest, he and his investigator canvassed the neighborhood where the arrest occurred and found a witness who, while thinking that she was sticking up for the police, contradicted their report. The case was later dismissed.
Assault cases are like murder cases, depending on the severity of the particular assault case. Otherwise, much of the dynamic is the same. However, there is a significant difference. In murder cases the victim is dead. In assault cases, the defense lawyer is presented with both the challenge and opportunity to cross-examine the victim.
