If you are charged with possession for sale, but the quantity is consistent with being a small time drug dealer, you are likely to be out on bail and looking for a lawyer. These cases are felonies and not subject to Proposition 36, drug court or deferred entry of judgment.
The possibilities are as follows. If you are not guilty, then a good lawyer should be able to obtain either a dismissal or an acquittal. Sometimes these cases are vulnerable to attack on grounds of illegal search and seizure. I have obtained no-jail plea bargains in cases such as this by doing just that, or by arguing that the client had a clean record. But, no two cases are alike, and the expectation in a case like this is County Jail or State Prison.
