Second Degree Murder Charge Held Up at Appeal

Defendant was convicted in the trial court of second-degree murder, driving under the influence causing great bodily injury, and driving with a blood alcohol level of .08 percent or higher causing great bodily injury. Defendant appealed. The appellate court affirmed. The court further held that the event data recorder (EDR) evidence obtained from defendant's vehicle pursuant to search warrant was relevant and admissible at trial for second-degree murder and driving under the influence.
